Please find enclosed completed document confirming I was the driver of vehicle reg XXXX XXX at the stated time and place.

I am concerned however that the information you have provided may be inaccurate.  I know the area in which you have stated I was driving over the speed limit by 8mph and as there are average speed cameras I use my cruise control in order to ensure I do not go over this limit. I am extremely carful to ensure my speed is consistent through these average speed cameras.

On that basis please can you confirm the accuracy, calibration dates and further evidence of my actual speed at that time (XX:XXhrs).

South Yorkshire Safety Camera Partnership can confirm that it does hold the information you have requested in relation to the camera system on the A616(T) East.

Section 17 of the Freedom of Information Act 2000 requires South Yorkshire Safety Camera Partnership when refusing to provide such information due to the information being exempt, providing the applicant with a notice which:

  1. States the fact,
  2. Specifies the exemption in question, and
  3. States (if that would not otherwise be apparent) why the exemption applies.

The exemption applicable to the information to which you have requested is Absolute in that it falls under section 21 of the Freedom of Information Act 2000.

Section 21(1) of the Act states that, ‘Information which is reasonably accessible to the applicant otherwise than under section 1 is exempt information’.

However, South Yorkshire Safety Camera Partnership acknowledges your request and under section 16(1) of the Freedom of Information Act 2000, which states it is the duty of South Yorkshire Safety Camera Partnership to provide advice and assistance, as far as it is reasonable to do so concerning the request for information.

The actual information that you have requested is for the specific camera that has captured your alleged offence.  This information is exempt under section 31(1)(a)(b) & (c) of the Freedom of Information Act 2000 which is Law Enforcement.  I hope that after reading the link above you can understand why this information is exempt.  I have however attached an up to date redacted certificate of calibration for the type of camera that captured your alleged offence, which might be of use to you.
