Request for copy of statements made by officers regarding a complaint
A complaint was made by myself to the police Reference: [removed] in late 2009.
As part of the complaint investigation carried out by Insp Kozieja, statements were taken from 2 officers who were the subject of my complaint: PC 1472 Rowley & PC3807 Kennedy.
I am requesting under the relevant Act, a copy of each of these statements for my attention.
Section 40- Personal Information (Partial exemption)
From my enquiries with our Complaints and Discipline department I have discovered that as the complaint was locally resolved, neither of these two officers made an official statement.
However, in my duty to assist you under section 16 of the Freedom of Information Act 2000, I have attached a copy of the emails that were sent from PC 1472 Rowley & PC 3807 Kennedy to their Inspector. I hope that this is sufficient.
Personal information has been redacted.
Section 17 of the Freedom of Information Act 2000 requires South Yorkshire Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which:
(a) states that fact;
(b) specifies the exemption in question and;
(c) states (if that would not otherwise be apparent) why the exemption applies.
The following exemptions apply to the disclosure of the information:
Section 40 (2)(a)(b) Personal Information
Any individual to which a request for information relates is exempt information if –
(a) it constitutes personal data which do not fall within subsection (1), and
(b) either the first or second condition in subsection (3) is satisfied. (would contravene any of the data protection principles)
A release under Freedom of Information is a release to the world, so therefore personal details such as addresses and scenes of crimes have been removed.
